Unlike some other states, California does not allow “use-it-or-lose-it” vacation policies. Under a “use-it-or-lose-it” policy, accrued vacation must be used by a certain date usually by the end of the year or it is forfeited. Because accrued vacation is considered earned wages, use-it-or-lose-it policies are seen as illegally withholding wages owed to employees.

Employers can, however, place a cap on vacation accrual. In other words, once employees reaches a certain number of days, they will stop accruing vacation until they use some of their vacation. This allows employers to maintain some control over vacation accrual and prevent employees from racking up unreasonable amounts of vacation time.

While there’s no set number for a permissible cap, the California Department of Labor Standards Enforcement the agency that enforces California wage and hour laws has provided some guidance. In the past, the DLSE has held that a vacation cap could be no less than 1.75 times the annual accrual rate. However, the DLSE has since withdrawn that bright line rule and instead states only that the cap must be “reasonable.” While a 1.75 cap is probably still the safest ratio, a 1.5 cap may also be within legal limits. What Is Paid Time Off

Paid time off, or PTO, is exactly what it sounds like. It is time that you take off yet get paid for, so youll request the time off and your employer will compensate you for it without you having to work. For example, lets say you request a date off from work, and you are paid for those hours at the same rate you would receive if you actually worked them.

There are a few types of PTO offered, including the following:

  • Unlimited PTO: Your company allows you to take as much time off as you need as long as it does not interfere with the completion of your work responsibilities.
  • Accrued PTO: You collect your time off over time. This is a standard type of PTO. For example, some employer accrual plans can be four hours of PTO per month or two hours for every 40 hours worked, but it all depends on your specific employer.
  • PTO bank: A PTO bank is a situation in which you have a set amount of PTO that you can use on an annual basis. The time might not transfer over from one year to the next, but whether it does or not is dependent on your specific employer.

Creating a PTO policy may not be as straightforward as employers would like it to be. After all, its not just a simple name change. What an employer calls their employees time off and how it is treated is important because it will affect the legal obligations attached to it.

Each state has its own set of laws regarding PTO or vacation, and employers must be compliant with the laws in their state. While there is no federal statute governing vacation or PTO policies, states have different laws regarding:

  • Whether vacation time is considered to be earned wages
  • Whether an employer can have a use it or lose it policy
  • Whether vacation wages must be paid out upon termination
  • Whether an employers policy sets the rules for vacation and PTO

As such, what state youre in will determine how you can structure your PTO policy.

That is exactly why the policy is the key . . . Most states leave it up to the employer to lay out a PTO and vacation policy. Some states, like California, have laws that limit how far a policy can go, but in every state, the most important factor is a clear, effective, and distributed policy. Daniel B. Best Practices For Implementing Vacation & Pto Policies

Theres no right or wrong answer when it comes to how much vacation or PTO your business should offer, but there are a few things to keep in mind when youre crafting your policy.

First, its important to be clear about the difference between vacation and PTO. Vacation is time thats set aside specifically for relaxation and leisure, while PTO can be used for anything from taking a mental health day to dealing with a sick family member.

Second, think about what type of company culture you want to foster. Do you want employees to feel like they can take some time off without judgment? Or do you want them to feel like they need to be working all the time?

And finally, make sure your policy is in compliance with state and federal laws. You dont want to get hit with a hefty fine because you didnt do your research!

When Separating Vacation Time And Sick Time Works

But when combining sick and vacation days into a single PTO plan, many companies slightly reduce the total number of days or hours offered. Your employees may feel cheated now that their sick and vacation days are combined. You may see fewer employees taking sick days even when warranted because theyd rather save their PTO for vacation time.

If this is a concern, keeping sick time off and vacation time off separate may make sense. It also ensures that your people take time off to go to a doctors appointment when they are ill to recover. This stops the spread of sickness around your office and gets them back to productivity faster.

Similarly, sick days are typically a use it or lose it item, where vacation time can typically carry over. Keeping the two separate can save you the liability of carrying forward more time than you might have to under a combined PTO bank approach.

In fact, one of the common downsides of a PTO program is this very liability. While you may experience gains from not having to track time off as you did under separate policies, you may pick up the burden of carrying forward more banked PTO days. Since employees natural inclination is to maximize their vacation time, you may see employees saving up unused PTO for what would have otherwise been used as sick days to add to their growing vacation bank.

What Is Paid Time Off And How Is It Different

Although used interchangeably, PTO and other types of holiday leave are different.

PTO is, simply, paid leave while an employee is away from work, or not working. This could include anything from sick days, personal days or vacation.

PTO policies can be delivered in quotas depending on days or hours. For example, based on working hours, an employee could nominate to deduct leave either hourly or daily.

If you wanted to deliver a PTO policy in a company with either part-time employees or seasonal workers, you could calculate it based around their pay period.

For example, if a business is on a biweekly pay schedule, which amounts to 26 pay days per year, you could credit your employee with a quota of PTO every two weeks based on their working hours.

If an employee were to work full time, you could also do it based on a ratio of hours worked. This calculation works by multiplying the pay periods an employee has worked against the accrual of PTO per period.
