Rules On Using Vacation Days

Some employers require employees to schedule their vacations well in advance. And employers are free to limit how much vacation time employees may take at once.

Employers may also impose a waiting period on using vacation time for new employees. Some employers, for instance, don’t allow employees to use any vacation during their first three to six months on the job. Even if the employees accrue vacation during this period, they may not use it until the waiting period is up.

Annual Accrual Vs Lump Sum

Most small businesses calculate PTO on a calendar year basis. In fact, if you grant PTO as a lump sum at the start of the year, you wouldnt need to manage accruals at all. On the calendar, fiscal, or anniversary date, employees would receive their lump sum balance to use throughout the year. You would then merely subtract hours for each day they take off until their PTO or vacation time is used up.

The three most common time frame options for granting and tracking PTO are:

A calendar year starts January 1 and ends on December 31. However, not all businesses use the same calculations for a given year. For example, some businesses are open 52 weeks a year, while others may close during the holiday season and work only 50 weeks a year.

Therefore, in addition to determining what constitutes a vacation accrual year for your business, youll need to figure out how many weeks, days, or work hours are available to work in that time frame, using the examples provided in step 3 above.

Some businesses set up their accounting year based on a fiscal start and end date used for accounting and tax purposes. For example, they may start their fiscal year on the first of September and end it on August 31.

How Vacation Time Accrues

Company policy determines how employees earn vacation time.

Some companies provide vacation leave or PTO that accrues on a monthly basis or is based on a certain number of hours worked. For example, employees may receive one day per month or eight hours of leave that they can take off for any reason.

Other companies provide vacation days based on years of service. In this case, the employee could be provided with a week for every year of service, up to a maximum number of weeks. If vacation leave is based on years of service, the employee is usually eligible to take it after they have worked for a year.

The amount of time off earned depends on company policy or the terms of a collective bargaining agreement for covered workers.

Eligibility For State Employees

State employees are entitled to be paid for the accrued balance of their vacation time if:

  • The employee resigns, is dismissed or otherwise separates from state employment,
  • The employee has accrued six months of continuous state employment at any time during the employees lifetime, and
  • The employee is not reemployed by the state in a position under which the employee accrues vacation leave during the 30-day period following the effective date of the employees separation from state employment. This does not apply to state employees who were employed by an institution of higher education at the time of separation from the state.

State employees who hold at least two positions and separate from one that accrues vacation time are entitled and eligible to be paid only for the vacation time credited to the position from which the employee separates.

What Is Pto Accrual

Paid time off accrual or accrued time off is a type of PTO that employees earn/accumulate over a period of time. Paid Time Off includes vacation leave, sick leave, personal leave, bereavement leave, etc. Employees can accrue their PTO on an hourly, weekly, bi-weekly, monthly, quarterly, annual, or per pay-period basis.

In fact, paid vacation days as a benefit are so common that potential employees expect paid vacation days as part of a comprehensive benefits package. Most organizations use a formula that assigns a certain number of hours accrued during each pay period based on time with the company.

Paid vacation days in the United States range from five to 30. In Europe and other parts of the world, paid vacation days are more liberal.

According to the Bureau of Labor Statistics, vacation paid time off varies by years of service in an organization.

  • One year of service receive an average of 8.1 paid vacation days
  • Three years of service receive an average of 10.2 paid vacation days
  • Five years of service receive an average of 11.9 paid vacation days
  • 10 years of service receive an average of 13.9 paid vacation days
  • 15 years of service receive an average of 14.8 paid vacation days
  • 20 years of service receive an average of 15.4 paid vacation days

Additionally, professional, technical, and related employees receive higher than average paid vacation days. For example, they receive 10 days after one year and 17.8 after 25. On average blue-collar and service positions receive less with 6.8 paid vacation days after one year and 14.1 after 25 years.

Recipients may use the additional days at any time, with their supervisors approval, and the days do not have to be taken all at once. Bonus vacation time that is unused is payable at termination of employment.

What Happens To Unused Paid Vacation Days

Each employer has a different policy for what happens to paid vacation days that go unused. Some employers have a rollover policy that allows you to carry a certain percentage of total vacation time into the next year. Other employers operate on a use-it-or-lose-it basis where you lose any unused days at the end of the year and start over in the new year.

There are similarly varying scenarios when it comes to unused vacation time when you leave a company. Federal law does not cover vacation time or pay. Some states require payment for accrued vacation time when an employee leaves a job. Others dont. How Much Pto Is Required

There is no set amount of PTO an employer is required to give an employee. According to the Fair Labor Standards Act , benefits are matters of agreement between an employer and an employee. The FLSA does state that an employer does not have to pay workers for time not worked, like vacations, sick leave, federal or other holidays.

The exception to the rule is for federal contractors.

  • On a government contract to which the labor standards of the McNamara OHara Service Contract Act apply, holiday and/or vacation fringe benefit requirements are stated in the SCA wage determinations in contracts that exceed $2,500.
  • On a government contract to which the labor standards of the Davis-Bacon and Related Acts apply, holiday pay and/or vacation pay is required for specific classifications of workers only if the Davis-Bacon wage determination in the covered contract specifies such requirements for workers employed in those classifications.

Decide How Much Pto To Provide Employees Annually

The first step to calculate a PTO accrual is to determine how many days or hours per year you want to grant your employees. According to SHRM, the average company grants 18 days of PTO, which may or may not include sick leave. That number reflects the fact that many firms tier their PTO programsfor example, giving new hires less time off, such as only one week off per year, while giving those with more years of service more time off, such as two or three weeks per year.

However, smaller businesses and startups may not be able to afford to give new hires that much paid time off. In fact, according to SHRM, 43% of businesses dont offer PTO at all. To keep our math simple, well use an example of two weeks .

To calculate PTO, this number will be converted to hours by multiplying the number of days provided by the standard hours worked per week.

Heres the math: two weeks = 10 days x 8 hours a day = 80 hours

How Does Vacation Time Work

Usually, vacation time accrues as an employee works. For example, if your job offers you 30 days of paid vacation per year, youll accrue about 2.5 days of vacation time per month. Theres an exception, though: employers can withhold vacation accrual for up to a year for new employees.

Employers are allowed to offer vacation time to some employees but not others, as long as theyre not withholding the benefit from people based on a protected characteristic . That means vacation time can be reserved for managers, full-time workers or executives and withheld from other employees.

What About Sick Leave?

Sick leave isnt the same thing as vacation time, and its not subject to the same rules. However, employers in California are required to provide a minimum number of paid sick days per year.
