Unlike the Wisconsin case, the Tennessee lawsuit actually went to court. Most timeshare lawsuits never reach a courthouse. Instead, they are settled out of court with confidential agreements between the timeshare owners and the timeshare companies. There are lawyers around the country who proudly specialize in getting owners out of their contracts & #8212 by threatening to sue over disclosure problems. Then they settle, and no one talks about the details. The Tennessee case, involving Nathan and Patricia Overton, is noteworthy because their complaints were publicly adjudicated in court.

The Overtons sued Westgate & #8212 a $1.4 billion company & #8212 to rescind a contract on grounds they were defrauded during their sales presentation and never provided adequate documentation for their $39,280 purchase in 2011. The trial court ruled in their favor and ordered Westgate to rescind the contract and repay their purchase money.

According to the appellate court’s Jan. 30 ruling: “The trial court found that the defendant had violated the respective statutory provisions and was guilty of fraud and misrepresentation.”

The court also awarded the Overtons $600,000 in punitive damages to “punish” Westgate for its business practices & #8212 which included a pattern, admitted by Westgate officials in court, of misleading potential buyers about their timeshares.

In addition to evaluating Westgate’s business practices, the courts examined Westgate’s ability to pay punitive damages.

The staff at Tuscan Village are attentive and the hotel amenities are great. The Vineland area around the hotel has plenty of varied restaurants and Disney World is only 15 minutes away. Would recommend!

I had an overall great experience with Hilton Grand Vacations. I did not buy their product or service. I just said “NO” and that was it. I completed all the requirements for the sales presentation and walked away. From the beginning, the salesperson that I spoke to by phone told me several times that I must attend the sales presentation in its entirety. The salesperson even stated in numerous times on the follow-up confirmation calls. It seems that a lot of folks jumped at the idea of a cheap vacation and never read the fine print or let themselves be talked into something they could not afford in the first place.

When Ellen Callis, a 68-year-old retired high school teacher from Phoenix, Arizona, first dipped her toes into the timeshare property market in August 2008, she was helping a colleague who was experiencing financial difficulties.

After investing in a second property in 2013, Ms Callis now says she has buyers remorse she is one of a growing number of timeshare owners desperate to quit burdensome contracts that extract hefty fees even when properties are unavailable to use.

“I am loath to add up how much I lost overall,” Ms Callis tells The National.

“Neither was an investment my investments are to make money, not toss it to the wind. I purchased pipe dreams of spending good times with family or friends, not investments.”

Ms Callis paid her former colleague about $3,000 for the timeshare property at the Wyndham Vacation Resort in the town of Flagstaff, 240 kilometres from her home and best known as the training base for Apollo 11 astronauts Neil Armstrong, Buzz Aldrin, Michael Collins and Charles Duke before they landed on the Moon in 1969.

Sedona seemed like an attractive place to enjoy a vacation, especially during the autumn apple-picking season, she says.

Wyndham Vacation Resorts did not respond to requests for comment.

A proposed settlement has been reached in a class action lawsuit. The lawsuit claims that Hilton Worldwide Holdings, Inc. and Hilton Grand Vacations Company, Inc. improperly rejected $100 and $200 Spend a Night on Us certificates provided to people who attended timeshare presentations offered by Hilton. Hilton denies these claims. The Court did not rule in favor of Plaintiff or Hilton. Instead, the parties agreed to the Settlement to avoid the expense and risks of continuing the lawsuit.

You are a class member if you are a resident of the United States of America who received a SANU certificate from Hilton that stated it was for use at any Hilton Hotel, and that Hilton refused to honor, based solely on the brand of Hilton hotel that the certificate holder had stayed at, during the period from January 15, 2012 through February 28, 2014.

If you are eligible, you will have the choice to either receive either:

  • $25 or $50 .
  • Your options and the deadlines to exercise them are explained further on the FAQ page of this informational website.

    Final approval was granted on February 4, 2021. On March 19, 2021, checks were mailed to class members who submitted a valid claim form and selected to receive the Cash Option. All other class members were sent a new SANU Rebate Certificate on March 19, 2021.
