Employees must receive at least 2 weeks of vacation per year for the first four years of employment, and a minimum of 3 weeks of vacation after the fifth consecutive year.

For each week of vacation, employees are entitled to 2% of the wages earned in that year, meaning that, employers may put vacation pay on every cheque, or they may choose to pay out at the time of the vacation leave.

Example 2 The Employee’s Period Of Employment Is Five Years Or More On Termination Of Employment

Dini was hired on June 1, 2013, and had an alternative vacation entitlement year that ran from January 1 to December 31 each year. He reached his five-year employment threshold on May 31, 2018. His employment was terminated on August 1, 2018. He had no vacation pay outstanding for any previously completed vacation entitlement years. Dini’s vacation pay for his last partially completed vacation entitlement year is six per cent of the wages earned between January 1, 2018 and August 1, 2018, because he had reached the five-year employment threshold prior to the termination.

Note: The vacation pay must be paid within seven days of the date Dini’s employment was terminated or by what would have been Dini’s next pay day, whichever is later.

Exemptions From The Minimum Standards For Vacations And Vacation Pay

Some employees who work in specified industries and professions arent eligible for annual vacations and vacation pay, including:

  • licensed or registered salespersons of real estate and securities
  • commission salespersons who solicit orders principally outside the place of business of their employer route salespersons are not exempt
  • extras in a film or video production
  • licensed insurance salespersons who are paid entirely by commission income
  • teachers

During his first four years, he receives 4% of $50,383 each year, which is $2,015.32 as his vacation pay. On his fifth year of employment, the bakery owners increase his annual vacation time to three weeks. During this period, he receives 6% of $50,383, which is $3,022.98.

Your Normal Weekly Earnings

Some earnings shown on the earnings chart are deducted from your benefits at the rate of your normal weekly earnings. Generally, your normal weekly earnings correspond to your regular weekly salary, before deductions, from your employment that paid the earnings. When you receive a weekly wage, the normal weekly earnings are calculated by multiplying the number of hours normally worked per week by the hourly wage rate.

Conversion examples for determining normal weekly earnings

  • Your rate of pay is $10 per hour and you normally work 40 hours per week. The normal weekly earnings will be $10 x 40 = $400.
  • Your bi-weekly salary is $800. The normal weekly earnings will be $800 ÷ 2 = $400
  • Your semi-monthly salary is $866.66. The normal weekly earnings will be $866.66 x 24 ÷ 52 = $399.99
  • Your monthly salary is $1,733.33. The normal weekly earnings will be $1,733.33x 12 ÷ 52 = $399.99, or
  • Your yearly salary is $20,800. The normal weekly earnings will be $20,800 ÷ 52 = $400

In addition to wages paid for normal and overtime hours, the normal weekly earnings can also include:

  • regular shift premiums
  • incentives or cost of living allowances
  • a percentage paid as vacation pay included with each pay, and
  • commissions paid at regular intervals or other amounts

When Can Employees Take Their Vacation

Employees are eligible for vacation once they have completed one year of work and must take their vacation within 10 months of it being earned. Employees and their employers can agree on when vacation will be taken.If an employer and employee cannot agree on when the vacation will be taken, the employer sets the vacation date. The employer must give the employee 15 days notice before the vacation is to be taken and cannot divide the vacation into periods shorter than one week. Employers can choose to schedule their employees’ vacations as part of an annual shut down.
