Huge Fine Increase For Illegal Short

On December 22nd, 2019, a huge fine increase for illegal short-term rentals in Maui County went into effect. Thinking about putting your property on Airbnb just to see what happens? Been renting out your ohana to vacation guests and somehow managed to fly under the radar to this point? My advice: Stop! Its not worth it.
Here is a link to the full code amendment. Instead of the previous fine structure, which some property owners viewed as the cost of doing business, new fines are $20,000 for the first offense and $10,000 per day afterward. That is not a typo. Let me repeat that so it sinks in

Maui County Affordable Housing Plan
On November 9, 2020 the Office of Council Services contracted local nonprofit, Hawaiian Community Assets, to assemble a team that engaged approximately 1,600 community members to identify recommendations and solutions for affordable housing for the County of Maui.
The final plan was presented to the Maui County Council on July 19, 2021.
Maui Halts New Construction Of Vacation Rentals Hotels
Maui has banned new construction of transient accommodations, including short-term rental properties, timeshares, and hotels, for up to two years. The Maui County Council voted to approve the moratorium on January 7, overriding Maui Mayor Michael Victorinos veto of the measure in December.
The moratorium on new construction permits for visitor units will be in place for two years, unless the county approves new legislation to address tourism management before then. In the meantime, a county council tourism investigative group has been studying ways to address issues of overtourism, affordable housing, and economic diversification for the island and compiling recommendations for action. The investigative groups final report is due later this month.
The challenge of balancing the economic benefits of tourism with the needs of permanent residents has been a hot topic of debate.
One response to this on Maui has been a crackdown on illegal vacation rentals. The state as a whole has also increased taxation on visitor units. A state law that went into effect this past summer allows counties to levy their own transient accommodation tax surcharge of up to 3% in addition to the states 10.25% TAT. Previously, counties received a portion of the state tax. Under the new system, counties no longer receive state TAT money, but can raise their own funds by imposing a county tax.

New Maui County Tvr Phase Out Bill
There is now a new piece of legislation on the table that some current Maui Council members have made about going after a select group of vacation rental condos were initially covered by the Minatoya Opinion and have now been codified into law is also a poorly thought out approach. Many of these condos are aging, are located on or very close to the shoreline , and have very high HOA fees that substantially increase the cost of ownership. How is a local family going to pay $800-1,500 per month in HOA fees for a one or two-bedroom condo on the ocean?
I will touch on this legislation specifically in a later post and illuminate why I think it is bad idea.
It is my opinion that Maui County needs to experience healthy and responsible growth. I personally lived outside of Waikiki on Oahu and that frankly was just overwhelming and is not the kind of growth I would like to see here. I will touch in on a later blog post about responsible development that I would like to see in Maui. Here is a bit more on that front. I encourage you to see and become educated on what Hawaii Community Assets has been doing for our communities. This 501c non-profit group was commissioned by the County of Maui to provide a comprehensive housing study. I believe that they have done a tremendous job with their work and I find it absolutely appalling that the Maui County Council has utterly disregarded their recommendations.

You can’t be everywhere at one time, so you need to get your guests a key to the house somehow. Ideally, you could hire someone to handle this for you, but you’d be responsible for paying for their travel, which could get expensive. Instead, you can offer a self-check-in or key management service by using smart locks or smart key safes.
With a smart lock, you can put a pin padlock on the door and make it accessible by app only so only you can create a pin for guests. Additionally, you can put a key safe on the door lock and control it with an app. This option is not a lock itself, it’s a safe that contains the key to the property.
Nothing is worse than a guest getting locked out without a backup key readily available. With a keypad or app-based entry, youll be able to make sure your guests are taken care of and this contingency never happens.

A Movement Towards Responsible Tourism
Although I am personally heavily vested in the business of tourism, I do strongly believe that it needs to be managed much better by Maui County as a state as a whole. With visitors not being on island for 9 months out of the year last year, it was a moment of clarity and appreciation for our citizens to enjoy the natural beauty of our islands. Seeing nearly empty beaches, flourishing wildlife, and no traffic was a stark contrast to what we are accustomed to in daily life. I for one am open to discussing ideas on how we can lawfully limit the number of visitors coming into our state and to help develop long-standing programs that will better educate our transient visitors about the delicacies and way of life that we want to see here. With this, I think it is also important for local Maui people to properly care for the land and to treat people respectfully provided that the respect is offered on the front end as well.

For years the county has been cracking down on illegal short-term rentals and refining their operations. Now theyve got the fine structure to really back it up. And guess what if you get caught, youre guilty until proven innocent. No exceptions for, I didnt know the law.
So what is the law? In Maui County, a short-term rental is defined as anything less than 6 months.
If you own a condo, the underlying zoning will allow for short-term rentals OR your condo building will be listed HERE as one of the county-approved properties. Is there a discrepancy between your condo association rules and the county regulations? Check with your AOAO Board of Directors as well your own independent real estate attorney to verify.
If you own a house, its a little more complicated. If the underlying zoning does not allow for short-term rentals, then youll have to go through an extensive permitting process with no guarantee of approval.
