Bass Pro Bluegreen Vacations Settle Dispute Over Timeshare Sales Tactics

Bluegreen Vacations, the timeshare marketer based in Boca Raton, FL, will pay more than $40 million to Bass Pro Shops to settle a dispute over Bluegreens alleged high-pressure sales tactics. The settlement allows Bluegreen to resume sales at kiosks inside Bass Pros locations.
On May 25, Bass Pro said it was kicking Bluegreen out of 69 stores where the timeshare developer operated kiosks. The retailer cited Bluegreens high-pressure or offensive salesmanship. Bluegreen denied that it violated the agreement or engaged in high-pressure sales tactics.
As part of the settlement, the two companies have amended their Marketing and Promotions Agreement that will reinstate Bluegreens access to Bass Pros marketing channels, including all marketing activities in Bass Pro retail stores and extend into the Cabelas retail stores.
The parties have entered into a Settlement Agreement and Amendment which provides that:

Bluegreen Timeshare Cancellation Policy
The rescission law is available for all Bluegreen timeshare and vacation club owners. If you recently purchased a Bluegreen Vacations package, you have the legal right to exit your contract. A typical rescission period usually lasts 3-10 days, and sometimes it can extend up to one month. If you have purchased your Bluegreen timeshare in that time frame, we suggest you contact Bluegreen immediately to see what your rescission period is on your contract.
Some timeshare developers require you to submit a written cancellation letter via mail. If you still qualify for your rescission period, we recommend you send everything in ASAP. Any documents submitted past your deadline, Bluegreen Resorts will not honor your request to rescind your contract. This is why we suggest you purchase overnight mail. How Bluegreen Responded To A Voided Partnership
Their resulted in a 50% plummet of the travel companys shares. In turn, Bluegreen had no choice but to mend the relationship monetarily. A few weeks ago, the timeshare company announced they will be paying an excess of $40 million over the next five years to Bass Pro Shops in order to resume selling fractional ownership in their stores. Bluegreens willingness to quickly fork over the cash shows how dependent they are on the retailer for revenue.
Aside from these hefty sums, they also agreed to pay Bass Pro $70k per year for each store they operate a kiosk in plus an additional $32.00 per vacation package sold less any cancellations and/or refunds. In April of this year, 16 co-plaintiffs filed another amendment in their lawsuit against Bluegreen Vacations. Their reasoning surrounds fraudulent misconduct that includes misleading sales tactics, statutory violations and a failure to point out the owners right of rescission. The damages theyre seeking restitution for began after a routine trip to a local Bass Pro Shop. The plaintiffs and others never really knew the extent of their timeshare purchase and believe theyve been intentionally manipulated.
